Terms and Conditions

These Terms and Conditions (“Agreement”) govern the relationship between Hind Cloud (“we,” “us,” or “our”) and you (“you,” “your,” or “client”) for the provision of web development, design, and related services. By engaging our services, you agree to be bound by these terms.

1. Services:

• Hind Cloud will provide the services outlined in the project proposal or agreement, which may include web design, development, maintenance, SEO, digital marketing, content writing, logo design, photo editing, video editing, web server setup, WordPress development, script installation, web server security improvements, and cloud instance setup.

2. Payment Terms:

• You agree to pay the fees as outlined in the project proposal or agreement.
• Payment schedules and methods will be detailed in the proposal or agreement.
• Late payments may incur additional fees or interest charges.

3. Project Timelines:

• Hind Cloud will strive to complete projects within the estimated timelines outlined in the proposal or agreement.
• Delays caused by circumstances beyond our control (e.g., client delays in providing content or feedback) may necessitate adjustments to timelines.

4. Client Responsibilities:

• You are responsible for providing accurate and complete information required for the project.
• You are responsible for obtaining any necessary licenses or permissions for content used on your website.
• You agree to cooperate with Hind Cloud and provide timely feedback to ensure project progress.

5. Intellectual Property:

• Upon full payment of all fees, you will own the final deliverables of the project, including website design, code, and content created by Hind Cloud.
• Hind Cloud may retain the right to use project elements for portfolio purposes unless otherwise agreed upon in writing.

6. Confidentiality:

• Both parties agree to keep confidential any proprietary information shared during the project.
• This confidentiality obligation will survive the termination of this Agreement.

7. Termination:

• Either party may terminate this Agreement with written notice if the other party breaches any material terms.
• Upon termination, you will be responsible for paying for any completed work and any non-cancellable expenses incurred by Hind Cloud.

8. Limitation of Liability:

• Hind Cloud will not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of our services.
• Our liability for any direct damages will be limited to the amount paid for the services in question.

9. Governing Law:

• This Agreement will be governed by the laws of Indian Jurisdiction.

10. Dispute Resolution:

• Any disputes arising from this Agreement will be resolved through good-faith negotiation. If negotiation fails, either party may initiate legal proceedings.

11. Entire Agreement:

• This Agreement constitutes the entire understanding between the parties and supersedes any prior or contemporaneous communications.
